C3 Essentials · Module 05

Contracts & Compliance.

A professionally managed transaction requires more than getting signatures on a contract. Agents must use the correct forms, obtain required disclosures, understand the executed agreement, maintain a complete transaction record and provide the documentation needed for brokerage compliance. Module 05 establishes the Coast to Coast Collective standard for Florida contracts and compliance.

Module Goal

Write It Correctly. Document It Completely. Deliver It on Time.

By the end of this module, agents should understand the C3 Florida compliance standard, where to obtain approved forms, which documents are required for common transaction types, how to handle conditional disclosures and how to deliver a complete file to the Transaction Coordinator.

48

Hours

Important Compliance Notice

Executed Documents Must Be Delivered to Lofty Promptly.

All executed transaction documents must be uploaded to Lofty and the applicable transaction information provided within 48 hours of execution. Lofty is the agent-facing C3 transaction record and the source the Transaction Coordinator uses to move the brokerage compliance process forward.

Agent Responsibility

Agent → Lofty

The agent uploads executed documents, keeps the client and transaction record current and provides the information needed for compliance and transaction coordination.

Transaction Coordinator

TC → REZen

The Transaction Coordinator handles the Real Broker REZen transaction, brokerage compliance submission, required file documentation and applicable commission-processing workflow.

Coast to Coast Collective Contract Standards

Four Rules Guide the Entire Module.

The individual checklist may change depending on whether you represent a buyer, seller, landlord, tenant or vacant-land client. These four standards do not.

01

Use the Correct Form

Use approved Florida real estate forms appropriate to the transaction and avoid non-standard contracts unless their use is required and authorized.

02

Complete the File

Required agreements, disclosures, MLS reports, public-record information and conditional forms belong in the transaction file.

03

Upload to Lofty

Executed documents and transaction information should not remain only in email, text messages or a signing platform. They belong in Lofty.

04

Read What Was Signed

Checklists help organize compliance, but the executed contract controls the actual terms, obligations, dates and transaction requirements.

Florida Forms Standard

Brokerage Guidance

FAR/BAR Is the Preferred Residential Contract Standard.

It is the firm's preference that Florida FAR/BAR forms be utilized for residential transactions. Avoid association-specific or non-standard contracts unless their use is mandatory and authorized. FAR/BAR documentation supports statewide consistency, legal transparency and brokerage compliance.

Module 05 Lesson Map

Florida Contracts & Compliance.

Work through the lessons in order. The first lessons establish the compliance standard, followed by transaction-specific Florida checklists and final risk-management guidance.

One Rule Above Every Checklist

The Executed Contract Controls.

The C3 compliance checklist helps organize the transaction file. It does not replace reading the contract. The actual signed agreement and applicable executed addenda, amendments and disclosures determine the terms and obligations of the transaction.

The C3 Compliance Mindset

Compliance Is Easier When the File Is Complete From the Beginning.

Use the correct documents. Get the required signatures and disclosures. Upload executed documents to Lofty promptly. Respond quickly when the TC identifies a missing item. Do not wait until closing to build the compliance file.

Module 05 · Step 02

Florida Forms & FAR/BAR Standard.

Contract compliance begins before a document is ever signed. The agent must first locate the correct Florida form, make sure it is appropriate for the transaction and use the brokerage-preferred contract standard whenever applicable. Start with the right form. Everything after that becomes easier.

Florida Realtors® Forms · Form Simplicity · Transaction Desk · FAR/BAR
Use the Correct Form

Coast to Coast Collective Contract Standard

Approved Forms Come Before Convenience.

Standard Florida real estate documentation is available through the form platforms provided as a benefit of your NAR and local Association membership. Use the appropriate Florida Realtors® documentation for the transaction and follow brokerage guidance when selecting the contract form.

01

Start With Approved Forms

Use the Florida real estate documents available through your approved forms platform.

02

Use the Right Transaction Form

Residential sale, vacant land, lease and other transaction types require different agreements and disclosures.

03

Follow Brokerage Guidance

For Florida residential sales, FAR/BAR documentation is the brokerage-preferred standard.

Accessing Florida Forms

Use Your Association-Provided Forms Platform.

Access to standard Florida real estate documentation is available through Form Simplicity or Transaction Desk. The platform available to you may depend on your local Association access.

Forms Platform

Form Simplicity

One of the standard resources agents may use to access Florida Realtors® contracts, agreements, disclosures and related transaction forms.

Forms Platform

Transaction Desk

Another Association-provided platform that may be used to access standard Florida real estate documentation and transaction forms.

Need Help Finding a Form?

Platform Support

Contact Your Local Association.

If you need help accessing your forms platform, locating a Florida Realtors® form or understanding how your Association provides access, contact your local Association for platform-specific instructions. C3 does not replace your local Association's support for accessing the forms systems included with your membership.

FAR/BAR Preferred

Important Florida Brokerage Guidance

Use FAR/BAR for Florida Residential Deals Whenever Appropriate.

It is the firm's preference that Florida FAR/BAR forms be utilized for residential deals. Avoid association-specific or non-standard contracts unless their use is mandatory and authorized. FAR/BAR documentation maintains statewide consistency, supports legal transparency and supports brokerage compliance for both the agent and the client.

01

Statewide Consistency

Using the brokerage-preferred Florida contract standard creates greater consistency across markets and transactions.

02

Legal Transparency

Standardized documentation helps create a more consistent framework for communicating transaction terms to the parties.

03

Brokerage Compliance

Using the brokerage-preferred documentation helps support a consistent compliance review process.

Non-Standard Contracts

Stop Before You Substitute

Familiar Does Not Automatically Mean Approved.

Some Associations, builders or local markets may use transaction-specific or association-specific contracts. Do not substitute a non-standard form simply because it is familiar or convenient. When another contract is mandatory, confirm that its use is authorized before proceeding.

Before You Prepare the Agreement

Identify the Transaction Before Selecting the Form.

The compliance checklist changes depending on the type of transaction and the party you represent. Start by identifying the transaction correctly.

01

Identify the Property

Residential sale, residential vacant land, lease or another transaction category.

02

Identify Your Client

Buyer, seller, landlord or tenant representation affects the required file.

03

Select the Correct Form

Retrieve the appropriate Florida Realtors® documentation from your approved forms platform.

04

Apply Brokerage Guidance

Use FAR/BAR for residential deals when appropriate and follow brokerage direction for exceptions.

Important

Having Access to a Form Does Not Mean It Belongs in Every Transaction.

Form libraries contain many agreements, disclosures, addenda and transaction-specific documents. The agent still needs to determine which documents apply to the actual transaction. Use the correct form for the transaction in front of you — not simply the form you used last time.

C3 Florida Forms Standard

Correct Transaction. Correct Form. Correct File.

Before preparing a Florida agreement, identify the transaction type, identify who you represent and retrieve the appropriate standard documentation. Use Form Simplicity or Transaction Desk for Florida Realtors® forms, use your local Association for access support, and follow the brokerage preference for FAR/BAR residential documentation.

Module 05 · Step 03

Required Brokerage Disclosures.

Brokerage disclosures are part of the transaction file — not optional paperwork to remember later. Deliver the applicable disclosures, obtain the required signatures and place the completed documents in Lofty. A disclosure that never reaches the client or never reaches the file does not help compliance.

Real Broker · Required Disclosures · Client Delivery · Lofty
Deliver + Document

Coast to Coast Collective Compliance Standard

Required Disclosures Belong in the Transaction File.

When a brokerage disclosure applies, it should be delivered to the appropriate client and completed as required. The final document should then be uploaded to Lofty so the Transaction Coordinator has the documentation needed for the Real Broker compliance file in REZen.

01

Know the Disclosure

Know which brokerage disclosures apply to the transaction and client.

02

Deliver It

Provide the applicable disclosure to the client at the appropriate stage of the transaction.

03

Complete It

Obtain the required signatures, initials or acknowledgment when applicable.

04

Upload to Lofty

Keep the completed disclosure with the client and transaction record for TC handoff and compliance.

Required Brokerage Disclosure Links

Keep These Three Resources Accessible.

Use the Real Broker resources below to access the current brokerage disclosure information and forms associated with these requirements.

01

Required Brokerage Disclosure

Use the Real Broker resource for the affiliated business disclosure relating to One Real Title & Mortgage. Complete and retain the applicable disclosure with the transaction file.

02

Use the Real Broker resource for the Consumer Choice and Referral Fee disclosure requirements. Apply the appropriate disclosure based on the transaction and client.

03

Required Brokerage Disclosure

Provide the applicable Wire Fraud Notice to your client and keep the completed documentation with the transaction record. Wire-fraud communication should be handled carefully and never treated as routine.

Disclosure Workflow

Retrieve → Deliver → Complete → Upload → TC Handoff

Treat brokerage disclosures as part of the normal transaction workflow rather than a separate task to remember later.

01

Retrieve

Access the current brokerage disclosure from the approved Real resource.

02

Deliver

Provide the applicable disclosure to the appropriate client.

03

Complete

Obtain the required acknowledgment or signatures when applicable.

04

Upload

Place the completed disclosure in the client's Lofty transaction file.

05

TC Handoff

The TC uses the completed Lofty file to complete the brokerage compliance workflow.

Agent → Lofty

C3 Compliance Handoff

Do Not Send the TC Hunting for Your Disclosures.

Once the disclosure is completed, upload it to the appropriate client and transaction in Lofty. The Transaction Coordinator should be able to open the file and find the completed documents needed for the REZen compliance process. The TC can manage compliance more efficiently when the Lofty file is already complete.

Common Disclosure Mistakes

Avoid Preventable Compliance Problems.

01

Forgetting the Disclosure

The transaction progresses and the required brokerage disclosure is never delivered.

02

Leaving It Unsigned

The form is sent, but the required acknowledgment or signatures are never completed.

03

Leaving It in Email

The completed document exists, but never makes it into the Lofty transaction record.

04

Waiting for the TC

The agent assumes the TC will somehow locate or recreate a document that was never provided.

Important

The Checklist Determines When Each Disclosure Is Required.

The disclosure requirements can differ depending on transaction type and who you represent. The upcoming residential sale, lease and vacant-land checklists identify where these disclosures appear in the C3 Florida compliance workflow. Do not assume every disclosure applies identically to every file.

C3 Brokerage Disclosure Standard

Deliver It. Complete It. Put It in Lofty.

Brokerage disclosures should never become a last-minute compliance scramble. Use the current Real Broker resource, provide the applicable disclosure to the client, complete the required acknowledgment and upload the final document to Lofty for the TC compliance handoff.

Module 05 · Step 04

Residential Sale Listing Compliance.

A compliant residential listing file begins before the property ever goes under contract. The listing agreement, disclosures, MLS documentation and property information should already be organized before a buyer's contract is added to the file. Build the listing file first. Then add the contract-stage documents when the property goes under contract.

Residential Sale · Listing Side · Active Listing · Under Contract · Lofty
Build the File as You Go

Coast to Coast Collective Compliance Standard

Do Not Wait Until Closing to Assemble the Listing File.

The listing file begins with the seller relationship and the executed listing documentation. When the property goes under contract, additional documents are added to that same transaction record. The agent keeps the file current in Lofty. The TC uses the completed Lofty file to manage brokerage compliance in REZen.

01

Listing Documents First

The listing agreement, disclosures, MLS report and property records belong in the file before the transaction reaches contract stage.

02

Add Contract Documents

Once an offer is executed, add the contract, escrow verification, pending MLS report and applicable contract-stage disclosures.

03

Upload Executed Documents

Executed documents must be uploaded to Lofty within the C3 48-hour compliance standard.

Listing File Structure

Think of the File in Two Stages.

The listing begins with the documents required to represent the seller and market the property. Once the seller accepts a contract, the compliance file expands to include the executed sale and contract-stage documentation.

Stage 01

Active Listing

Seller representation, listing agreement, MLS documentation, property records and required disclosures.

→

Stage 02

Under Contract

Executed purchase contract, escrow verification, pending MLS documentation and applicable contract-stage forms.

Stage 01 · Listing

Required Residential Listing Documents.

These documents make up the current C3 Florida residential listing compliance file. Items marked "if applicable" are included when the transaction requires them.

Residential Sale & Purchase · Listing

Agent → Lofty

Upload the executed documents, maintain the seller and transaction record, provide required supporting documentation and respond when missing items are identified. Your responsibility is to give the TC a complete Lofty file.

Transaction Coordinator

TC → REZen

The TC uses the Lofty transaction record to create and maintain the Real Broker compliance file in REZen, identify missing requirements and manage the brokerage compliance workflow.

C3 Listing File Standard

One Client. One Property. One Complete Transaction Story.

The listing agreement, property information, disclosures, MLS documentation, executed purchase contract and contract-stage records should remain connected to the same seller relationship in Lofty. Do not scatter the transaction across email, your phone, a signing platform and disconnected files.

Important

The Checklist Supports the File — the Executed Documents Control the Transaction.

This checklist identifies the current Coast to Coast Collective residential listing compliance documents. It does not replace reading the actual listing agreement, purchase contract or applicable addenda and disclosures. Always work from the documents actually executed in the transaction.

Residential Listing Completion Standard

Build the Listing File Before You Need the Closing File.

A compliant listing file starts when the seller signs the listing agreement — not when the property goes under contract. Complete the active-listing documents, add the under-contract documents when executed, upload them to Lofty within the required timeframe and give the TC a complete file for REZen compliance.

Module 05 · Step 05

Residential Sale Buyer Rep Compliance.

The buyer compliance file should show the complete representation and purchase transaction. That includes the buyer representation agreement, executed purchase contract, escrow documentation, transaction disclosures and any conditional forms required by the deal. A complete buyer file should make it clear who you represent, what was executed and which disclosures apply.

Buyer compliance is not just the purchase contract. The file includes the buyer representation agreement, transaction documentation, applicable brokerage disclosures and supporting records required for the file. Upload the executed documents to Lofty. The TC handles the REZen compliance process.

01

Representation

The file includes the applicable Buyer Broker / Touring Agreement establishing the buyer relationship.

02

Contract

The fully executed residential sale and purchase contract belongs in the transaction record.

03

Include when applicable to the buyer's financing and transaction.

  • ✓

LBP — Lead-Based Paint Disclosure If Applicable

Include the applicable Lead-Based Paint Disclosure when required for the transaction.

If Applicable

Conditional Buyer Documents

Not Every Buyer File Is Identical.

Some transaction documents are required only when specific facts of the transaction apply. The C3 checklist identifies these separately so agents do not treat them as universal or forget them when they are needed.

01

FHA / VA Financing Addendum / Rider

Include the applicable financing addendum or rider when the transaction requires FHA or VA documentation.

02

Lead-Based Paint Disclosure

Include the applicable LBP disclosure when the transaction requires lead-based paint documentation.

Buyer File Logic

Think Beyond the Contract.

The purchase contract is central to the transaction, but the compliance file must also document representation, escrow, disclosures, MLS status and applicable transaction-specific forms.

01

Who Do You Represent?

Make sure the buyer representation documentation belongs in the file.

02

What Was Executed?

Upload the actual executed contract and applicable signed transaction documents.

03

What Applies?

Identify the disclosures, compensation documents and conditional forms applicable to the file.

04

Is It in Lofty?

The completed compliance file should be accessible from the buyer's Lofty transaction record.

48

Hours From Execution

C3 Compliance Handoff

The TC uses the buyer's Lofty file to manage the Real Broker transaction and compliance process in REZen and communicate any missing file requirements.

Important

The Checklist Does Not Replace the Executed Contract.

This checklist identifies the current C3 residential buyer compliance documents. The actual purchase contract and applicable executed addenda, riders and disclosures control the transaction in front of you. Read what was signed. Do not manage the transaction from memory or from the checklist alone.

Residential Buyer Completion Standard

Complete Representation. Complete Contract. Complete File.

The residential buyer file should contain the buyer representation documentation, executed contract, escrow verification, required disclosures, pending MLS report, compensation documentation and applicable conditional forms. Upload executed documents to Lofty within the required timeframe and give the TC the complete file needed for REZen compliance.

Module 05 · Step 06

Residential Lease Compliance.

Lease transactions require the same discipline as residential sales. The required file changes depending on whether you represent the tenant or the landlord and whether the listing is still active or has moved into an executed lease. Identify your side first. Then build the correct lease file.

Tenant Rep · Listing · Executed Lease · Flood Disclosure · Compensation · Lofty
Know Which Side You Represent

Coast to Coast Collective Lease Standard

Tenant Files and Listing Files Are Different.

A residential lease transaction may involve tenant representation, landlord representation or a listing that moves from active into an executed lease. Each path has its own required documentation. Build the file that matches the representation and transaction status.

01

Identify Representation

Determine whether you represent the tenant or the landlord before selecting the compliance checklist.

02

Match the Status

An active listing file and an executed lease file require different supporting records.

03

Upload to Lofty

Executed lease documents and applicable disclosures belong in Lofty for the TC handoff.

Lease Compliance Paths

Three File Stages to Know.

Use the checklist that corresponds to your representation and the current stage of the residential lease transaction.

01

Tenant Representation

The tenant-side compliance file centers on the executed lease, flood disclosure, pending MLS documentation and tenant-broker compensation agreement.

02

Active Lease Listing

The landlord listing file begins with the Exclusive Right to Lease Agreement, flood disclosure, active MLS report and tax record.

03

Listing Under Contract

Once the lease is executed, add the lease agreement, pending MLS report, flood disclosure and compensation documentation.

Tenant Representation

Required Tenant Rep Documents.

When representing the tenant, build the transaction file around the executed lease and the supporting lease-specific documentation.

The TC uses the Lofty file to manage the Real Broker compliance process in REZen and communicate any missing transaction requirements.

Important

Do Not Use the Sale Checklist for a Lease Transaction.

Residential leases have their own agreements, disclosures, MLS documentation and compensation forms. Identify the transaction as a lease, identify which party you represent and use the lease-specific checklist.

Residential Lease Completion Standard

Correct Side. Correct Status. Correct Lease File.

Residential lease compliance begins by determining who you represent and where the transaction is in the process. Use the tenant checklist for tenant representation, the listing checklist for landlord representation, add the under-contract documents once the lease is executed, and upload executed documents to Lofty within the required timeframe.

Module 05 · Step 07

Residential Vacant Land Compliance.

Residential vacant land transactions require their own agreements, disclosures and supporting compliance documents. Do not treat a vacant-land transaction as though it were a standard residential-home sale. Identify the property type, identify who you represent and use the vacant-land-specific forms.

Residential vacant land transactions use land-specific listing agreements, contracts and disclosure documents. The file also changes depending on whether you represent the seller or buyer and whether a listing has moved under contract. Use the vacant-land checklist — not the residential-home checklist.

01

Identify the Property

Confirm the transaction involves residential vacant land before selecting the forms.

02

Identify Representation

Listing-side and buyer-side vacant-land files have different documentation requirements.

03

When a vacant-land listing agreement, purchase contract or other transaction document becomes fully executed, upload the completed document to Lofty within 48 hours of execution. Keep the transaction record complete so the TC has what is needed for the brokerage compliance process.

Agent

Agent → Lofty

Upload the executed land documents, maintain the transaction record, provide the applicable disclosures and supporting records, and respond to missing-file requests. Give the TC a complete Lofty transaction.

Transaction Coordinator

TC → REZen

The TC uses the Lofty file to manage the Real Broker transaction and compliance process in REZen and communicate any remaining requirements.

Important

Do Not Substitute Residential Home Forms for Vacant Land Forms.

Vacant land has its own listing agreement, purchase contract and disclosure statement in the C3 compliance checklist. Use the transaction-specific documents that match the property and representation.

Residential Vacant Land Completion Standard

Land Transaction. Land Forms. Complete File.

Residential vacant land should be treated as its own transaction category from the beginning. Use VLLA-6 for the listing, VAC-15 for the purchase contract, VLDS-1 for the vacant-land disclosure, add the applicable supporting documents, and upload executed records to Lofty within the required timeframe.

Module 05 · Step 08

Conditional Forms & Disclosures.

Not every transaction requires the exact same set of documents. Financing type, property characteristics, compensation arrangements, referrals and listing circumstances can trigger additional forms. “If applicable” does not mean optional. It means you must determine whether the requirement applies to this transaction.

FHA / VA · Lead-Based Paint · Flood · Compensation · Referral · MLS Waiver
If Applicable ≠ Optional

Coast to Coast Collective Compliance Standard

The Transaction Facts Determine the File.

A checklist cannot predict every fact of every real estate transaction. Some forms are therefore listed as conditional requirements. The agent must identify the facts that apply to the deal and include the appropriate documentation. When the condition applies, the document belongs in the file.

01

Read the Transaction

Identify the actual financing, property, compensation and referral facts.

02

Identify the Trigger

Determine which conditional forms or disclosures apply to the file.

03

Complete the Document

Obtain the applicable signatures, initials or acknowledgment.

04

Put It in Lofty

Keep the completed conditional document with the rest of the transaction record.

Common Conditional Requirements

Recognize the Trigger Before You Miss the Form.

These are the conditional items identified throughout the current C3 Florida compliance checklists.

01

Financing

FHA / VA Financing Addendum or Rider

Include the applicable financing addendum or rider when the buyer's transaction requires FHA or VA documentation.

02

Property

Lead-Based Paint Disclosure

Include the applicable Lead-Based Paint Disclosure when the transaction requires lead-based paint documentation.

03

Property / Transaction

Flood Disclosure

Include the applicable Flood Disclosure where required by the transaction checklist. For the C3 vacant-land checklist, this is specifically identified when the land is zoned residential.

04

Compensation

Seller Funded Buyer Broker Compensation

Include the applicable buyer-broker compensation documentation when seller-funded compensation applies to the transaction.

05

Referral

Referral Fee Disclosure

Include the applicable Referral Fee Disclosure when a referral-fee requirement applies to the transaction.

06

Listing

MLS Waiver

Include the MLS Waiver when it applies to the residential listing file.

What Does “If Applicable” Mean?

Compliance Decision Point

It Means Stop and Check the Facts.

When the checklist says “if applicable,” do not automatically skip the item. Review the actual transaction: financing type, property characteristics, representation, compensation arrangement, referral structure and executed documents. If the condition exists, complete the applicable documentation.

Conditional Document Workflow

Identify → Confirm → Complete → Upload → Communicate

Treat conditional compliance as part of the normal transaction workflow, not something to discover when the TC asks for a missing document.

01

Identify

Review the transaction facts and identify possible conditional requirements.

02

Confirm

Confirm which conditional forms or disclosures belong in the transaction.

03

Complete

Obtain the required completed and executed documentation.

04

Upload

Place the completed document in the appropriate Lofty transaction record.

05

Communicate

Make sure the TC has what is needed to complete the compliance workflow.

Before You Consider the File Complete

Ask the Conditional Questions.

A quick review of the transaction can prevent many missing-document issues.

  • ✓

    What financing is being used?

Determine whether the financing triggers an applicable FHA / VA addendum or rider.

  • ✓

Does the property trigger an additional disclosure?

Check the applicable property-related requirements, including Lead-Based Paint or Flood documentation.

  • ✓

    Is seller-funded buyer-broker compensation involved?

Include the applicable compensation documentation when required by the transaction.

  • ✓

Is there a referral-fee disclosure requirement?

Include the applicable referral documentation when the transaction requires it.

  • ✓

Does the listing require an MLS Waiver?

Include the applicable waiver when required for the listing file.

  • ✓

Are the conditional documents in Lofty?

A completed document that remains only in email or a signing platform is not a complete C3 transaction file.

Complete the Handoff

Agent → Lofty

The TC Cannot Submit a Form You Never Provided.

Once a conditional form or disclosure is completed, place it in the appropriate Lofty transaction record. This gives the Transaction Coordinator the documentation needed to complete the Real Broker compliance process in REZen.

Agent

Identify + Provide

Recognize the transaction facts, obtain the applicable forms, complete the documentation and upload it to Lofty. Do not assume the TC knows a transaction fact that was never communicated.

Transaction Coordinator

Review + Process

The TC reviews the available Lofty file, identifies missing compliance items and manages the brokerage submission process in REZen.

Important

Do Not Guess When You Are Unsure Whether a Form Applies.

Review the executed contract, the transaction facts and the applicable compliance checklist. If the requirement is still unclear, confirm the appropriate documentation before treating the file as complete. It is easier to clarify a requirement early than repair a missing compliance document later.

Conditional Document Completion Standard

If the Condition Applies, the Document Belongs in the File.

Conditional documents are not lesser compliance requirements. They simply depend on the facts of the transaction. Identify the trigger, complete the applicable form, upload the executed document to Lofty and make sure the TC has what is needed for the REZen compliance process.

Module 05 · Step 09

Dates, Escrow & Contract Changes.

A contract is not simply a form that gets signed and placed in a file. It contains dates, obligations, deposit requirements and terms that guide the transaction. When those terms change, the documentation must change with them. Read the executed contract. Track the current agreement. Document every executed change.

Effective Date · Deadlines · Escrow · Amendments · Extensions · Lofty
The Executed Contract Controls

Coast to Coast Collective Contract Standard

Manage the Agreement That Was Actually Signed.

Transaction dates, deposit obligations, contingencies and closing requirements come from the actual executed agreement and any later executed changes. Do not rely on memory, an old draft, a previous transaction or a checklist to tell you what this contract says.

01

Read the Contract

Know the terms, dates and obligations contained in the executed agreement.

02

Identify the Dates

Determine the transaction milestones from the contract actually signed by the parties.

03

Document Changes

Changes to agreed terms should be reflected in the appropriate executed transaction document.

04

Update Lofty

The current transaction record should contain the original agreement and later executed changes.

Contract Dates

Find the Dates in the Agreement — Not in Your Memory.

The specific dates and deadlines vary according to the executed contract and the provisions selected by the parties. Read the agreement carefully and identify the dates that govern the transaction in front of you.

01

Effective Date

Identify the effective date of the executed agreement because other contractual deadlines may depend on it.

02

Deposit / Escrow

Identify the deposit obligation, applicable timing and designated escrow information from the contract.

03

Contingency Milestones

Identify the applicable inspection, financing and other contract-driven milestones contained in the agreement.

04

Closing Date

Confirm the agreed closing date and update the record if the parties later execute a change to that date.

Do Not Calculate From Memory

Contract Date Standard

Similar Contracts Can Still Have Different Terms.

Do not assume a deadline is the same because your last transaction used a similar contract. Terms may be completed differently, dates may be negotiated, and later executed documents may modify the original agreement. Open the current contract. Read the current terms.

Earnest Money & Escrow

Contract-Driven Obligation

The Deposit Requirements Come From the Contract.

The executed agreement identifies the applicable earnest-money or deposit obligation. Review the actual contract for the amount, timing, escrow holder and other applicable terms. The C3 compliance checklists also require an Escrow Deposit Verification Letter for applicable residential sale and vacant-land purchase files.

01

Read the Obligation

Identify what the executed contract requires regarding the deposit.

02

Track the Requirement

Keep the applicable escrow milestone visible in the transaction workflow.

03

Obtain Verification

Include the required Escrow Deposit Verification Letter when it belongs in the compliance file.

04

Keep Lofty Current

Make sure the transaction record contains the applicable escrow documentation.

Changes After Execution

If the Deal Changes, the Documentation Changes.

A conversation, text message or verbal understanding should not become the only record of a change to the transaction. When the parties formally modify an agreement, keep the applicable executed documentation with the transaction file.

01

Amendments

When the parties execute an amendment to the agreement, retain it with the original contract.

02

Extensions

If a contractual date is formally extended, the executed extension belongs in the transaction file.

03

Addenda / Riders

Applicable executed addenda and riders remain part of the complete agreement record.

04

Other Executed Changes

If the parties formally change a transaction term, retain the executed document that reflects that change.

Contract Change Workflow

Execute → Upload → Update → Communicate → Track

Once a contract change is fully executed, the transaction record and the team workflow should reflect the new agreement.

01

Execute

Confirm the applicable change has been properly executed by the required parties.

02

Upload

Add the executed change to the appropriate Lofty transaction.

03

Update

Update the applicable transaction information affected by the change.

04

Communicate

Make sure the TC and applicable transaction parties have the current information.

05

Track

Manage the transaction from the updated agreement, not the superseded information.

Original Agreement

Keep the Executed Contract.

The original executed agreement remains part of the transaction history. Do not delete or replace it simply because a later document changes one of its terms.

Later Executed Change

Add the Change to the Same File.

The amendment, extension, addendum or other executed change should remain connected to the original transaction. The complete file should show how the agreement evolved.

48

Hour Standard

New Executed Document = File Update

Contract Changes Go to Lofty Too.

The 48-hour compliance standard does not end with the original contract. When another transaction document becomes executed, add the completed document to the appropriate Lofty transaction within the required timeframe. The TC needs the current file in order to keep REZen and the brokerage compliance record current.

Agent

Agent → Lofty

Read the contract, know the changes, upload newly executed documents and update the transaction information affected by those changes. The TC should never have to work from an outdated version of the deal.

Transaction Coordinator

TC → REZen

The TC uses the current Lofty file to maintain the brokerage compliance record in REZen and track the updated transaction documentation provided by the agent.

Important

This Lesson Does Not Create Contract Deadlines.

This section teaches the C3 compliance standard for identifying, documenting and maintaining contract dates, escrow information and executed changes. The actual rights, obligations, notice requirements and deadlines come from the executed contract, applicable executed documents and appropriate brokerage guidance.

C3 Contract Change Standard

If the Agreement Changes, the File Changes.

Read the executed agreement. Identify the controlling dates. Understand the applicable escrow requirement. Retain the original contract. Add every applicable executed amendment, extension, addendum or later change. Keep Lofty current, keep the TC informed and manage the transaction from the agreement the parties actually signed.

Module 05 · Step 10

Lofty Submission & TC Handoff.

Every contract, disclosure and compliance requirement in this module eventually comes back to one operational standard: the agent builds and maintains the transaction in Lofty, and the Transaction Coordinator uses that file to complete the brokerage compliance process in REZen.

Executed → Lofty → Complete File → TC Handoff → REZen

48

Hours From Execution

C3 Compliance Standard

Executed Documents Go to Lofty.

All executed transaction documents must be uploaded to Lofty and the applicable transaction information provided within 48 hours of execution. Lofty is the agent-facing Coast to Coast Collective transaction record. The Transaction Coordinator uses the information and documents in Lofty to manage the Real Broker compliance workflow in REZen.

Agent Responsibility

Agent → Lofty

Prepare and execute the documents correctly, upload executed documents, maintain the client and transaction record, provide supporting compliance information and respond promptly when something is missing. Everything involving the client or transaction belongs in Lofty.

Transaction Coordinator

TC → REZen

The TC reviews the Lofty file, creates and manages the brokerage transaction in REZen, uploads brokerage-required documentation, manages compliance requirements and handles the applicable commission-processing workflow.

The C3 Compliance Handoff

Five Steps From Signature to Brokerage Compliance.

The handoff should be predictable. Once a document is executed, move it into the transaction record, make sure the file is complete and give the TC what is needed to manage the brokerage process.

01

Execute

Confirm the applicable document has been fully executed by the required parties.

02

Upload to Lofty

Place the completed document into the correct client and transaction record.

03

Complete the Record

Add the supporting documents, parties, dates and transaction information needed for the file.

04

TC Handoff

Make sure the TC has a usable and current Lofty file instead of scattered documentation.

05

REZen Compliance

The TC manages the Real Broker transaction and brokerage compliance process in REZen.

Remember the Workflow

Executed → Lofty → Complete File → TC → REZen

The Agent-Facing Transaction Record

What Belongs in Lofty?

Lofty is not simply a place to upload the final contract. It is the operating record for the client and transaction.

Agent → Lofty

The Complete C3 Transaction Record.

Keep the transaction information connected to the client from execution through closing.

01

Client Information

Maintain the complete client relationship and transaction record connected to the correct contact.

02

Executed Documents

Contracts, agreements, disclosures, amendments and other executed documents belong in the file.

03

Supporting Records

MLS reports, tax records, escrow verification and other applicable supporting compliance items.

04

Transaction Parties

Keep applicable lender, title, escrow, co-broke and referral information connected to the transaction.

05

Dates & Changes

Maintain the current transaction information when executed documents change contractual dates or terms.

06

Transaction History

The file should preserve the story of the transaction rather than forcing someone to reconstruct it later.

Before the TC Handoff

Ask: Could the TC Work From This File Right Now?

Before considering your handoff complete, review the Lofty transaction for the information below.

  • ✓

Is the correct client attached to the transaction?

The file should be connected to the correct client relationship in Lofty.

  • ✓

    Are the executed documents uploaded?

Do not leave the final signed version only in email or an electronic-signature platform.

  • ✓

    Are the required disclosures present?

Include the applicable brokerage and transaction-specific disclosures.

  • ✓

Are the supporting compliance records included?

Add the applicable MLS reports, tax records, escrow verification and other required supporting items.

  • ✓

    Is the transaction information current?

Make sure later executed documents and changes are reflected in the file.

  • ✓

Have you responded to any missing-item request?

A file is not complete simply because the TC identified what is missing.

What the TC Does Next

TC → REZen

The TC Manages the Brokerage Compliance Process.

Once the transaction information and documents are available in Lofty, the Transaction Coordinator uses that record to manage the Real Broker transaction in REZen. REZen is the brokerage compliance system. Lofty remains the C3 client and transaction operating record.

01

Review Lofty

Review the transaction information and documents supplied by the agent.

02

Manage REZen

Create and maintain the Real Broker transaction and compliance file.

03

Identify Missing Items

Communicate missing documents, signatures or compliance requirements back to the agent.

04

Process Compliance

Manage applicable brokerage review, CDA and commission-processing workflow.

Common Handoff Failures

Do Not Make the TC Reconstruct Your Transaction.

01

Documents Left in Email

The document exists, but it never reaches the Lofty transaction record.

02

Missing Final Version

A draft or partially executed document is uploaded instead of the completed version.

03

Transaction Changes Missing

An amendment or extension changes the deal, but Lofty still reflects the old information.

04

Assuming the TC Owns Everything

TC support does not replace the agent's responsibility to prepare, understand and provide a complete file.

Critical Distinction

TC Support Does Not Transfer the Agent's Contract Responsibility.

The Transaction Coordinator provides substantial administrative and compliance support. That does not relieve the agent from understanding the transaction, using the correct forms, obtaining required signatures, delivering required disclosures or providing the documents needed for the file. The agent owns the client relationship and the accuracy of what is being prepared and executed.

C3 Submission Standard

Agent → Lofty. TC → REZen. Every Time.

The cleanest compliance process starts with a complete transaction record. Execute the correct documents, upload them to Lofty within 48 hours, maintain the current transaction information, respond quickly to missing-file requests and let the TC manage the Real Broker compliance workflow in REZen.

Module 05 · Step 11

Compliance Mistakes & Risk Management.

Most compliance problems do not begin as major problems. They begin with a missing signature, an incorrect form, a disclosure that was never delivered, a document left in email, or an agent who was unsure and guessed instead of asking. Good risk management starts with disciplined habits.

Correct Forms · Complete Signatures · Required Disclosures · Current File · Escalate When Unsure
Do Not Guess

Coast to Coast Collective Risk Standard

Stop the Problem Before It Enters the File.

Compliance problems are easier to prevent than to repair. Use the correct forms, review what is being signed, complete the required disclosures, maintain the current file and ask for guidance when something is unclear. Do not guess on a form, deadline, disclosure or contractual obligation.

01

Prevent

Use the correct form and build the compliance file correctly from the beginning.

02

Review

Read the executed documents and check the file for missing information.

03

Correct

Respond promptly when a missing or incorrect compliance item is identified.

04

Escalate

When the correct answer is not clear, stop and ask the appropriate resource.

Common Compliance Mistakes

Small File Mistakes Can Create Bigger Problems.

Watch for these recurring issues before they become last-minute compliance problems.

01

Wrong Form

A familiar, convenient or locally common document is used instead of the appropriate approved form.

02

Missing Signature or Initial

The document appears complete, but one or more required signatures, initials or acknowledgments are missing.

03

Missing Disclosure

A required brokerage or transaction disclosure was never delivered, completed or retained in the file.

04

Conditional Form Skipped

An item marked “if applicable” is treated as optional without checking whether the condition actually applies.

05

Outdated Transaction Record

A later amendment, extension or contract change is executed, but Lofty still reflects the original information.

06

Documents Left Outside Lofty

The final document lives in email, text, downloads or the signing platform but never reaches the transaction file.

07

Waiting Too Long

Executed documents are not uploaded promptly, leaving the TC and brokerage record behind the actual transaction.

08

Managing From Memory

Dates, obligations or requirements are assumed from a prior transaction instead of the current contract.

09

Guessing Instead of Asking

The agent is unsure which form, disclosure or contractual requirement applies and proceeds without clarification.

Stop & Ask

When You Are Unsure

Clarification Is a Risk-Management Tool.

If you are unsure which form applies, whether a disclosure is required, how a contractual provision should be handled, or what documentation the brokerage needs, stop and ask the appropriate broker, leadership, Association or transaction resource. Guessing does not make the transaction move faster if the file has to be repaired later.

Risk Management Workflow

Read → Verify → Document → Upload → Escalate

Strong compliance habits reduce preventable problems throughout the transaction.

01

Read

Read the document and understand what is actually being prepared or executed.

02

Verify

Check the form, signatures, transaction facts and applicable requirements.

03

Document

Make sure the applicable agreement, disclosure or change is properly documented.

04

Upload

Put the completed transaction document in the correct Lofty file.

05

Escalate

If something remains unclear, ask the appropriate resource before moving forward.

Protect the Transaction Record

A Complete File Protects More Than Compliance.

A strong transaction record helps everyone understand what happened, what was signed, what changed and what information was available throughout the transaction.

01

Protect the Client

Clear documentation helps preserve the agreements and disclosures connected to the client's transaction.

02

Protect the Transaction

Current documents and accurate records reduce confusion as the deal changes.

03

Protect the Brokerage File

Complete Lofty documentation allows the TC to maintain the required brokerage compliance record.

04

Protect the Agent

A complete transaction history helps document what was executed, disclosed and communicated.

Agent

Agent → Lofty

Use the correct documents, obtain complete execution, keep the transaction current and provide the information needed for compliance. Do not assume the TC can fix a document the agent never properly completed.

Transaction Coordinator

TC → REZen

The TC reviews the available Lofty file, manages the brokerage compliance process in REZen and communicates missing or incomplete file requirements.

The Rule to Remember

If You Are Unsure About a Form, Deadline, Disclosure or Contractual Obligation — Stop and Ask.

A checklist can guide the workflow, but it cannot replace the executed agreement or appropriate brokerage guidance. Never guess your way through a compliance or contract question.

C3 Risk Management Standard

Correct Forms. Complete File. Clear Record. Ask When Unsure.

Strong compliance does not come from fixing files at the end. It comes from making better decisions throughout the transaction. Use the right forms, obtain complete signatures, deliver the required disclosures, keep Lofty current, respond to missing items quickly and escalate questions instead of guessing.

Module 05 · Step 12

Florida Compliance Checklist.

You have now worked through the C3 contract and compliance standards for residential sales, leases and residential vacant land. This final lesson brings those requirements together into one reference. Identify the transaction. Use the correct checklist. Complete the applicable documents. Keep Lofty current.

Residential Sale · Residential Lease · Vacant Land · Listing · Buyer Rep · Lofty
Start With the Transaction Type

Final Module 05 Compliance Standard

The Correct Checklist Starts With the Correct Transaction.

Before deciding which documents belong in a file, identify the property type, identify who you represent and identify the current transaction stage. Then use the matching compliance checklist and confirm whether any conditional documents apply.

01

Identify

Property type, representation and transaction stage.

02

Match

Use the compliance checklist that matches the actual transaction.

03

Complete

Include the required and applicable conditional documents.

04

Upload

Keep the current transaction file complete in Lofty.

Before You Call the File Complete

Final File Review

Run the Entire Transaction Through One Last Check.

A file is not complete simply because the main contract is signed. Confirm the transaction type, representation, required forms, conditional items, signatures, disclosures, supporting records and Lofty documentation. Then respond to any remaining TC compliance requests.

01

Correct Transaction?

Confirm the property and transaction type.

02

Correct Side?

Confirm whether you represent buyer, seller, tenant or landlord.

03

Correct Documents?

Use the checklist that matches the file.

04

Conditional Items?

Confirm every “if applicable” requirement.

05

Complete Execution?

Check signatures, initials and acknowledgments.

06

In Lofty?

Confirm the current file is available to the TC.

48

Hour Standard

Final Module Reminder

Executed Documents Go to Lofty.

All executed transaction documents must be uploaded to Lofty and the applicable transaction information provided within 48 hours of execution. The TC then uses the complete Lofty record to manage the Real Broker compliance process in REZen.

Agent

Agent → Lofty

Correct forms. Complete execution. Required disclosures. Current transaction record. Everything involving the client or transaction belongs in Lofty.

Transaction Coordinator

TC → REZen

Review the Lofty file, manage brokerage compliance, identify missing requirements and complete the applicable REZen workflow.

Module 05 Final Standard

The Executed Contract Controls. The Complete File Protects the Transaction.

Checklists help you build a disciplined file, but they do not replace the agreements actually signed by the parties. Read what was executed. Use the correct forms. Deliver the required disclosures. Document changes. Keep Lofty complete. And when you are unsure — stop and ask.
